PRELIMINARY INFORMATION: The Florida Lottery “Gold Rush Social Giveaways” (the “Giveaways”) begins at 8:00:00 a.m. Eastern Daylight Time (EDT) on January 18, 2021 and ends at 11:59:59 p.m. EDT on April 4, 2021. (the “Giveaways Period”). The “Administrator” of the Giveaways is PPK, located at 1102 N Florida Ave. Tampa, FL 33602.

ELIGIBILITY: The Giveaways is open only to legal U.S. residents residing in the state of Florida, who are 18 years of age or older at the time of entry (“Participant”). Employees, officers, directors or agents of the Florida Lottery (“Sponsor”), Sponsor’s contractors and subcontractors, Administrators, their respective affiliates, parent companies and subsidiaries, and each of their respective divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, and advertising and promotion agencies (collectively, the “Giveaways Entities”) and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) and any others engaged in the development, production, execution or distribution of the Giveaways are not eligible to participate.

ENTRIES: Participants are limited to one (1) entry per platform (one entry for following the Florida Lottery on Instagram and an additional entry for following the Florida Lottery on Twitter) to be randomly selected for a chance to win electronics and gift cards. If more than one entry is submitted by a participant, only the first entry received by that participant will be eligible. Winners will be selected using the nth number entry selection process. Each entry will be chronologically assigned a number based on the date and time entry is received by the Florida Lottery. Non-winning participants can re-enter to win during remaining giveaways. A winner in the Giveaways is ineligible to enter or win in any subsequent entry period(s) in the Giveaways. Questions regarding the Giveaways should be directed to advertising@flalottery.com.

The Florida Lottery will not be responsible or liable for failure to receive entries due to transmission failures or technical failures of any kind, including without limitation, electronic malfunction of any network, hardware or software. Proof of submission does not constitute proof of entry. The Florida Lottery reserves the right in its sole discretion to cancel or suspend any Giveaway should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the Giveaway. In the event of cancellation of any Giveaway, the prizes will not be awarded. Use of information collected in connection with any Giveaway is governed by the Florida Lottery.

The prizes will be shipped to confirmed winners via UPS or a comparable carrier within 90 business days of the confirmation of a winner. The prize is non-transferable. Prizes cannot be sold, transferred or bartered in whole or in part. No prize substitution or exchange will be allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value at its option. The winner is solely responsible for any and all taxes on the prize, including, but not limited to all applicable federal, state and local taxes if applicable. All other costs and expenses not expressly set forth herein shall be solely the winner’s responsibility. Sponsor shall not be held responsible for any delays in awarding a prize for any reason. Prizes will only be awarded to a winner whose eligibility is verified. Sponsor makes no representation to winner as to the fitness or suitability of the prize for any purpose, and Sponsor hereby disclaims any and all warranties, express or implied, concerning any prize.

WINNER NOTIFICATION; ODDS: Winners will be announced twice monthly on the Florida Lottery Facebook page. Winners will be notified via the email provided by a Participant, pursuant to the instructions contained herein, within 10 business days of the winner’s selection date schedule (see “Prizes” section I). Winners must respond to the Florida Lottery email within 10 business days of issuance of the email to them in order to claim their prize. All responses must conform to these Terms and Conditions and guidance provided in the email notification to be eligible. Odds of winning a prize depend on the number of eligible responses received during the Giveaways Period. In order for an online entry to be valid, participant must have a valid email address. If the registration process is aborted before it is complete, participants are not eligible to win. Any attempt by any participant to obtain more than the stated number of entries and/or submit entries by using multiple/different email addresses, accounts identities, registrations, logins, and/or any other methods will void that participant’s participation and that participant may be disqualified from the Giveaways, in Sponsor’s sole discretion. If (A) Sponsor is blocked from contacting the potential winner due to any privacy settings; (B) the potential winner is found to be ineligible; (C) the potential winner cannot or does not comply with these Terms and Conditions; or (D) if prize or prize notification is returned as undeliverable, the potential winner will be disqualified and forfeit the prize and Sponsor will select an alternate potential winner from the remaining eligible entries received during the Giveaways Period. Unclaimed prizes may not be awarded. Sponsor’s decisions are final and binding on all matters relating to the Giveaways.

GENERAL REQUIREMENTS OF PARTICIPATION: By participating in the Giveaways, participants agree to be bound by these Terms and Conditions. All federal, state and local laws apply. Any attempted form of participation in the Giveaways other than as described herein is void. Entries received from any participant in excess of the stated limitation will be void. Multiple participants are not permitted to share the same email address. If it is discovered that a participant attempts to receive additional entries in excess of the stated limitation, including, without limitation, if a participant is found to use multiple email addresses to enter this Giveaways, that participant may, at Sponsor’s sole discretion, be disqualified from the Giveaways. In the event of a dispute regarding the identity of the person submitting an entry, the “authorized account holder” (determined at time of entry) of the account used to enter will be deemed to be the participant. The “authorized account holder” is the natural person who is assigned to the email address through the email platform. Potential winners may be required to show proof of being the authorized account holder.

Sponsor reserves the right to disqualify any individual found, in Sponsor’s sole discretion, to be tampering with the operation of the Giveaways, to be acting in violation of these Terms and Conditions, or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of the Giveaways. Any use of robotic, automatic, macro, programmed, third party, or like methods to participate in the Giveaways may void any attempted participation effected by such methods and may result in the disqualification of the individual utilizing the same. Sponsor reserves the right to disqualify from the Giveaways any participant it believes has violated these Terms and Conditions, any Lottery rule, and any statute. Sponsor may prohibit a participant from participating in the Giveaways or winning a prize if, in its sole discretion, Sponsor determines that said participant is attempting to undermine the legitimate operation of the Giveaways by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants, Sponsor, or any of the Giveaways Entities. If for any reason the Giveaways is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaways, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaways and select a winner from those entries received up to the cancellation/suspension date, without obligation or liability.

CAUTION AND WARNING: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE THE GIVEAWAYS WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAYS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES AND LITIGATION/ADMINISTRATIVE PROCEEDING COSTS) OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT, TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. In the event of any conflict with any details contained in these Terms and Conditions, any Lottery rule, any statute and any details contained in any promotional materials of the Giveaways (including, but not limited to, point-of-sale, television and print advertising, promotional packaging, and other promotional media), the details of the Giveaways set forth in these Terms and Conditions shall prevail.

LIMITATION OF LIABILITY: By participating, participants acknowledge and agree that Sponsor, Sponsor’s contractors and subcontractors, and the Giveaways Entities and each of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) are not responsible for, and shall have no liability for (1) entries that contain incomplete or inaccurate information or do not otherwise comply with these Terms and Conditions; (2) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged, garbled, misdirected, or otherwise not received by Sponsor or its agents for any reason; (3) any typographical or other error in the printing or advertising of this Giveaways, the administration or execution of this Giveaways, or in the announcement of a prize winner; or (4) any problems or technical malfunctions, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Giveaways.

By participating in the Giveaways, participants agree to be bound by the Terms and Conditions of the Giveaways and all decisions of Sponsor which are final and binding in all respects. By participating in the Giveaways, participants and winners agree to and hereby waive, release, discharge, indemnify and hold harmless the Released Parties from and against (A) any and all liability of whatever type or nature, for loss, harm, damage, injury, cost or expense whatsoever with respect to or in any way arising from the Giveaways and/or use of the prize, including, without limitation, property damage, liability for personal injury (including emotional distress), and/or death caused, in whole or in part, directly or indirectly, from the awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or participation in any Giveaways related activity or participation in the Giveaways, and (B) for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor reserves the right, in its sole discretion, to disqualify any participant that Sponsor finds to be (i) tampering with the entry process or the operation of the Giveaways, or (ii) acting in violation of these Terms and Conditions. If Sponsor determines, in its sole discretion, that this Giveaways cannot be executed as planned, including, but not limited to, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity, or proper conduct of this Giveaways, or if this Giveaways is compromised in any way, electronically or otherwise, Sponsor reserves the right to terminate this Giveaways, and to award the prize by random drawing from all eligible entries received prior to the date of cancellation or suspension, without obligation or liability.

DISPUTES: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of participant and Sponsor in connection with the Giveaways, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of laws of any jurisdiction other than the State of Florida. If any part of these Terms and Conditions is deemed to be invalid or otherwise unenforceable or illegal, the balance of the Terms and Conditions shall remain in full force and effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Participants agree that (1) any and all disputes, claims, and causes of action arising out of or connected with this Giveaways or any prize awarded shall be resolved individually, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, and exclusively by a federal or state court located in Florida, with venue of Leon County, Florida, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaways, but in no event attorneys’ fees, and (3) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. FURTHER, SPONSOR DOES NOT WAIVE SOVEREIGN IMMUNITY, AS DEFINED UNDER FEDERAL OR STATE LAW.

PUBLICITY RIGHTS: By participating in the Giveaways and/or accepting a prize, each participant agrees to allow Sponsor and its designees the perpetual worldwide right to use and/or publish participant’s name, biographical information (exclusive of street address and telephone number/s), photos and/or other likeness, entry comments, and statements, in whole or in part, for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, without additional compensation or notice to participant, or review or approval by winner, except where prohibited by law.

PRIVACY POLICY: Any personal information collected during a participant’s participation in the Giveaways will be collected by Sponsor or its designee and used by Sponsor, and its affiliates, designees, agents and marketers for the purposes of the proper administration and fulfillment of the Giveaways as described in these Terms and Conditions and otherwise in accordance with Sponsor’s Privacy Policy as stated at https://flalottery.com/privacyPolicy.
